Mistrial in the Nevada Bundy Ranch trial

I reported a few weeks ago on the release of most of the Bundy’s from jail during pre-trial, which was amazing in and of itself because the judge had just previously to this ruling said that the defendents were a “danger to the community”.    However as the trial has went on and on the obvious facts of government corruption have come out including but not limited the obstruction by BLM Agent Dan Love, and others.   

The ruling of the mistrial today was in part because of the “suppression of evidence” by the prosecution and law enforcement.   Which is more evidence of obstruction.   

If this was the other side doing these things, the government would of course heap more felonies on the defendants.  
Since it is the government engaging in corruption, theft (of cattle), and suppression of evidence, nothing will happen, except dozens of men have lost years of their lives behind bars.

This story is just breaking, but I will quote the words of Carol Bundy, who is Cliven Bundy’s wife.

“Today our prayers were heard and the current trial against my husband, sons and other defendants was declared a mistrial. We wanted a dismissal but are grateful that the truth is getting out. We are a step closer to freedom.

Although the case is not over and there will continue to be lots of legal back and forth I needed to thank you, on behalf of our entire family for your prayers and support.

You stood with my family when it would have been easier to look the other way. You shared our message so the media eventually had to begin covering the truth.

It’s been almost two years since my husband has been home, had a home cooked meal and was able to wear his cowboy hat. I’m hopeful that soon we’ll be able to enjoy those simple things that so many times we simply took for granted.

This may not be over, as the judge has not ruled yet on if the mistrial ruling is with or without prejudice.   Although seeing the evidence of government corruption, and what would become a permanent public record of this corruption if the defendants were retried, it is not likely to continue.  

All said, I do pray that the government leaves this family and this ranch alone.

Also another big win for states rights, and the limitation of the federal government.   Donald Trump just reduce the size of two MASSIVE land grabs this region.

This is something that started before Donald Trump was elected, both the land grab by then President Obama, and the fight to overturn the land grab.

“It started well before,” said Boyd Matheson, president of the Sutherland Institute, which helped lead the fight against the monument and subsequently to shrink it. “Every elected official from the mayors to the commissioners, every single elected representative, got engaged in it. It was the real, Utah cumulative, everybody-pull-together kind of thing.”

Obama, as expected, named 1.35 million acres of federal land as the Bears Ears National Monument in late December, just a month before leaving office. Tribes and environmentalists celebrated, but Utah officials were angry.

 This is not directly related to the Bundy Ranch, however past government land grabs and the recent establishment of the BLM (Bureau of Land Management) is something that plays a big part in the Bundy Ranch protest.
This is about 10th Amendment states rights, about property rights, about Federal Government’s established enumerated powers, and massive government over reach.

It boils down to this, limitation of the government in the constitution via the Property Clause;

INTERPRETING THE PROPERTY CLAUSE OF THE CONSTITUTION

THE PROPERTY CLAUSE, Art 4, Sect 3, Cl 2
The Congress shall have Power to dispose of and make all needful Rules and Regulations respecting the Territory or other Property belonging to the United States; and nothing in this Constitution shall be so construed as to Prejudice any Claims of the United States, or of any particular State.

THE ENCLAVE CLAUSE, Art 1, Sect 8, Cl 17
To exercise exclusive Legislation in all Cases whatsoever, over such District (not exceeding ten Miles square) as may, by Cession of Particular States, and the Acceptance of Congress, become the Seat of the Government of the United States, and to exercise like Authority over all Places purchased by the Consent of the Legislature of the State in which the Same shall be, for the Erection of Forts, Magazines, Arsenals, dock-Yards, and other needful Buildings;–

And so with that I agree with what Donald Trump said when he dedicated this release of Federally grabbed state land;

Trump told supporters at the state Capitol, “I’ve come to Utah to take a very historic action, to reverse federal overreach and restore the rights of this land to your citizens.”

“Past administrations have severely abused the purpose, spirit and intent of the century-old law known as the Antiquities Act,” Trump said, referring to the law used by Clinton and Obama to create the monuments.

He said presidents are supposed to set aside in monuments only the smallest area necessary to protect important resources. Instead, he said, previous administrations put millions of acres into the monuments.“Some people think that the natural resources of Utah should be controlled by a small handful of very distant bureaucrats located in Washington. And guess what? They’re wrong,” Trump said to cheers.

“The families and communities of Utah know and love this land the best, and you know the best how to take care of your land,” he said.

Trump said the “abuses of the Antiquities Act have not just threatened your local economies; they’ve threatened your very way of life” by limiting access to public lands.

Now, he said, “Public land will once again be for public use.”

Before the ceremony, Interior Secretary Ryan Zinke told The Salt Lake Tribune: “The president is delivering on his campaign promise to give the state and local communities a voice, which I think is absolutely important. Public lands are for public use and not for special interests.”

Trump’s order specifically authorizes grazing in the Bears Ears area as well as motorized recreation and American Indian gathering of wood and herbs, and it asks Congress to pass legislation to mandate co-management by tribal leaders.
